Overview
These Terms of Service apply to the website and online store branded Christmas Lights Wholesale at christmaslightswholesale.ca. “We”, “us” and “our” refer to Christmas Lights Wholesale. By using our website or placing an order, you agree to these terms and the policies linked from them, subject to any rights that applicable law does not allow you to waive. Our online store is hosted by Shopify.
1. Online store use
You must have legal capacity to enter into a purchase agreement, or use the store with appropriate authorization. Use the website and products lawfully. Do not introduce malicious code, interfere with the service or use another person’s identity or payment details without authorization.
2. General conditions
We may refuse or restrict service for lawful reasons, including suspected fraud, security concerns or misuse. Ordinary shopping does not require a trade account. Restrictions will not override applicable consumer rights or unlawfully discriminate. You may not misuse, reproduce or commercially exploit our website content without permission or another lawful basis.
3. Product and website information
We aim to present clear product descriptions, specifications and images. Screen settings can affect how colours appear. Check the selected variant, pack quantity, length, connection type and electrical requirements before ordering. Contact us if information is unclear or inconsistent. General guides do not replace product instructions or qualified advice where needed.
4. Prices and service changes
Prices, promotions and product availability may change for future orders. The currency and applicable item price must be identified before checkout. Taxes, shipping and any applicable cross-border charges will be disclosed as required. A price change does not by itself change an already accepted order. We may update or discontinue site features, subject to our obligations for existing orders.
5. Products, variants and use
Availability can depend on the selected colour, pack, length or other option. Product suitability and compatibility must be checked against the actual specifications; sharing a category does not establish compatibility. Follow installation instructions and applicable requirements. Custom or non-stocked orders may have specific written terms disclosed before purchase. Returns are governed by the confirmed Return & Refund Policy and applicable law.
6. Orders, billing and account details
Provide accurate contact, billing and delivery information and keep account credentials secure. We may review an order for payment authorization, stock or suspected fraud before acceptance. If we cannot fulfil an order, need to correct an error or cancel an order, we will contact you using the information supplied and address any payment collected in accordance with applicable law. Bulk customers, installers and resellers are welcome; no general reseller prohibition is imposed by these terms.
7. Optional tools
Some functions may rely on third-party providers. Their separate terms may apply where disclosed. We are not responsible for a third party’s independent service beyond our own legal obligations.
8. External links and installation services
Links may take you to other websites. Review their terms and privacy practices. Our GTA installation link directs you to settoshine.ca. Installation enquiries, quotations and bookings are handled separately through Set to Shine; purchasing supplies does not include installation unless expressly agreed in writing.
9. Enquiries, feedback and submissions
Provide information you are entitled to share and do not submit unlawful, misleading or harmful content. We may use your enquiry details to respond and your feedback to improve our service. Sending an enquiry does not authorize us to publish your private message, personal details or photographs as marketing material. Personal information is handled under our Privacy Policy.
10. Personal information
Our Privacy Policy explains the handling of customer information, service providers, cookies and privacy requests. We will request consent where required. Do not send full payment-card details, passwords or unnecessary sensitive information by email.
11. Errors and corrections
We may correct errors in descriptions, prices, quantities or availability. If a correction affects an order, we will explain the issue and the available next steps before proceeding where required. These terms do not authorize misleading representations or remove remedies required by law.
12. Prohibited activity
Do not use the website for fraud, harassment, discrimination, infringement, unauthorized collection of personal information, malicious software, spam or attempts to bypass security. We may limit access in response to misuse, without removing obligations that already apply to accepted orders.
13. Service availability, warranties and liability
We cannot promise uninterrupted or error-free website access. Any specific product warranty must be stated in the product or warranty information; these terms do not create an additional product warranty. To the extent permitted by law, we are not responsible for indirect or consequential losses arising from website use or circumstances outside our reasonable control. No exclusion limits liability or any condition, warranty or remedy that applicable law does not allow us to exclude. In particular, nothing here removes mandatory rights concerning defective, misdescribed or undelivered goods.
14. Responsibility for misuse
You are responsible for losses directly caused by your fraudulent or unlawful misuse of the website to the extent established under applicable law. This provision does not require you to reimburse us for our own unlawful conduct or waive consumer protections.
15. Severability
If a provision cannot lawfully be enforced, it will apply only to the extent permitted, or be severed if necessary. The remaining provisions continue to apply, subject to applicable law.
16. Ending access
You may stop using the website at any time. We may suspend access for lawful security or misuse reasons. Ending access does not cancel obligations relating to an accepted order, a valid refund or a privacy request.
17. Agreement and interpretation
These terms, the policies linked from them and the terms of an accepted order form the agreement for the relevant service. A specific written agreement can supplement them. Failure to enforce a provision is not a waiver of that provision. Nothing here overrides mandatory law or an express commitment made for your order.
18. Governing law
These terms are intended to be governed by the laws of Ontario and the federal laws of Canada applicable there, without depriving a customer of mandatory protections or access to remedies that apply in their own jurisdiction.
19. Changes to these terms
We may update these terms for future use of the website. We will identify the updated version and provide notice or request agreement where required. Changes do not retroactively remove rights relating to an existing order.
